By purchasing artwork from me, you are automatically agreeing to the following terms. These terms are subject to change at any time.
Please read thoroughly and contact me before requesting a commission if you have any questions or at khaoticvex@gmail.com

I have the right to decline or cancel and refund a commission for any reason, especially if the request does not adhere to the Terms of Service.

Commission queue is public information that can be found on Trello.

The client must ensure they like my personal art style or specify if they prefer a mimicked style from a show/anime/book/otherwise. I will NOT mimic the style of another freelance or individual artist.

The relationship between the myself and the client is to be kept professional and respectful. I am hired for one purpose: to create original artwork according to the client’s request. Roleplay, inappropriate links or text, requests for friendship, casual talk or otherwise will be ignored. This behavior will result in a commission cancelation and ban.

Commissions are listed in USD and are priced for hobbyist clients. Commercial prices will be quoted individually and vary based on circumstances

Prices and quotes are non-negotiable. If the client is unable to afford the provided quote, please be considerate when informing me.

Openings are random and will be announced on social media and this website. To be notified of commission openings, ask to be added to the ping list.

Request a commission via google form, email or contact link.

Commissions will be publicly organized into categories on Trello, if they are accepted. This is where tracking can be found. There are checklists on each card/slot.

If the commission is accepted, I will contact the client confirming acceptance, and will provide a quote and ask any additional questions necessary.

After the details and quotes are confirmed, the commission will be placed in the “Queued” category. Payment will NOT be requested at this time.

When I am ready to begin working on a commission listed in the “Queued” category, the client will be contacted and informed. Payment WILL be requested at this time.

Once payment has been made, the commission will move to the “Working On” category, and I will begin the commission.

Work in progress (WIP) will be provided to the client in multiple stages including sketch, line + flat color, shading, background. The WIP varies between commission types. The client must give a clear confirmation to me after the sketch WIP, for work to continue onto the line + coloring stages.

Some types such as icons, chibis, sketches and animated icons are exempt from WIPs, as they are usually completed in one sitting.

Major changes can only be made during the sketch stage, such as posing and expressions. Please view Additional Charges and Discounts for more details.

As the commission nears completion, it will be moved to the “Finishing Touches” category.

When the commission is finalized, it will be moved to the “Finished” category and the full resolution image will be sent to the client.

I may upload the commission to my Patreon and galleries at any time. The client may post the commission before the artist, with credit provided.

I am only available to work on commissions during weekends but is not guaranteed to be every week.

Smaller commissions will be completed at faster rates than larger commissions.

Multiple commissions are worked on at once, interchangeably.
-
Turnaround time begins after the date of payment, NOT after the date of contact or acceptance. Queue times are difficult to know and confirm, but rough estimates may be provided. These estimates are not always accurate and can fluctuate.

Illustrations and small animations have a turnaround estimate of 1 week to 6 months.

Comics and large animations have a turnaround estimate of 6 weeks to 1-year minimum. Depending on the size of these time-consuming commission types, they may exceed these time frames and their maximum turnaround will vary.

These are new and uncommon commission types, therefore they are difficult to guarantee accurate time frames of at this time.

Large commissions are marked on Trello with a black label titled “flexible due date/BIG commission.” These commissions will move between the usual WIP categories and an additional “On Hold” category to avoid burnout for best artistic results.

If a commission is expected to experience delays, I will inform the client to the best of my ability. Large delay notices that affect multiple commissions will be posted on Trello and social media.

Prices are listed in USD.

Payment plans are accepted for commissions if discussed and confirmed in advance. Payment plans may delay commission turnover.

I will work around your schedule as needed for paydays and can invoice for specific dates if requested to do so.

Do not send money to me without my consent. This includes sending money to my Paypal email directly before I have agreed to you doing so.

Tips are always enabled on invoices and are encouraged. If you prefer to tip after commission completion, Kofi is an option for doing so. Artistree will allow for tips after it is completed.

To receive priority on my queue there is a minimum fee of 40% to be bumped to the top of it.

If a commission needs to be completed in a specific time frame or has a due date, a priority fee will be customized accordingly, or may not even be necessary if informed in a timely manner. (Ex: during finals, I may charge more, or short time periods like a week)

If the client does not have a single flat colored, design-accurate visual reference of their character, an additional 20% fee will be charged for that character. This includes written descriptions. References sheets may be purchased alongside other commissions at any time, even if listed as unavailable, to avoid this fee.

Private commissions can be requested at an extra cost. To be partially private and only posted on my Patreon, the fee is 30% of the total. To be entirely private, posted nowhere from my end, the fee is 50% of the total.

Character designs premade by me qualify for a discount of 20% on all commission types. This does not apply for custom character design commissions.

Livestreams may be purchased alongside commissioned work as an additional 30% fee. During commissioned livestreams I will work solely on your commission for a slotted amount of time.

Process recordings/speed draws and PSD files may be purchased for an additional $20 fee. PSD files can be requested for no charge for reference sheet commission types.

Holidays will sometimes feature themed discounts - my most common discounted commission is Valentine's Day, with a romantic couple theme. These prices will be adjusted and announced separately from the normal price list.

Occasionally the opportunity of discounted commissions will come up in the case of needing new examples, wanting to work on a specific subject matter, or in emergency cases. These will be separate price lists and be announced showing such.

A commission can be canceled at any time by me or the client.
-
In the case of a cancelation, a refund will be provided depending on the current stage of work.
-
100% refund when canceled before sketch.
-
50% refund when canceled before linework.
-
20% refund when canceled before color.
-
Any other or in-between stages will have a percentage that suites the work completed.
-
After completion of a commission, no refund is provided.
-

Cancelation that is made within 24hr of payment will result in 100% refund, but commissions may not be accepted in the future for this client.

When a commission is canceled after being worked on, the client is allowed to save and keep whatever WIP provided for them. I also retain the right to recycle the WIP as another commission (YCH), or my own personal work. In these circumstances, the reworked art will resemble the initial WIP, but will feature a new character for a new client. This would be more common for sketches or linework stages. Recycling does not change how much percent of the commission is refunded in a cancelation.

Chargebacks are not allowed at any point in time. In the case of this happening, the client will be blocked and put on a blacklist. By filing a chargeback, the client loses all rights to the commissioned work regardless of the stage it is in. I will recycle the commission to recover financial loses.
The client has the rights to:

Repost and publish their commission where they would like, with credit given.

When crediting, please provide a link to my website or relevant social media profile (linking my username in DA, FA, Twitter, etc). Writing “art by KhaoticVex” is acceptable, but a link is preferable.

In the case of a commission being 18+ content, please refrain from crediting my normal username, KhaoticVex, and use my 18+ one as intended. I will remind the client and list this username to them directly.

Use their commission as a banner, profile picture, twitch display, emojis, or other non-commercial use.
-
Print commissioned work as posters, charms, stickers, shirts or other merchandise for personal use.

Get tattoos of my artwork. Tattoo artists may edit the original drawing as requested by the client. All I request is to be tagged or credited by the tattoo artist, client, or tattoo shop in any posts.
The client does NOT have the rights to:

Profit financially from my artwork without paying for commercial prices.

If commissioned work was initially paid for using hobbyist prices, but the client would like to later add commercial rights, this can be done at any time by contacting me for a quote and information.

Resell my work without commercial rights with the exceptions of the following circumstances:

Selling the rights of a character within artwork.

If the client resells a character or design, I created, please inform me so I may credit the new owner. Please respect me as the original designer and do not sell the character for more than purchased unless it is being grouped with other art or merchandise.

Claim the commissioned work as their own. They may claim the idea, character, concept, and overall theme as theirs. The artwork is credited to me as the artist.
-
Remove my signature or alter my artwork without my consent.
-
Exceptions may be allowed in the use of icons, emotes, or transparent files. Please request for a watermark-less version for private use.

Have other artists edit or alter my artwork. Please go through me.

Redlining is an exception during WIP stages, please by all means doodle over my work to show me what needs changing.

Sell or use my artwork for NFT or AI purposes or use.
-
I have the right to display commissions on my Patreon, galleries, portfolio, commission examples or elsewhere to represent my work. This includes college or job related opportunities, such as scholarships or applications should I ever need it.

I do not have the right to display commissions if private commission fees are requested and paid for by the client. I will adhere to any agreements made at the time of purchase.

In the case of fan art commissions, I retain the right to upload and possibly monetize on them from merchandise sites such as RedBubble or Society6. I will inform the client of these decisions. If the client wishes to avoid this, a partial private fee can be determined.

I will not profit from commissions of original characters or concepts unless otherwise agreed upon myself and the client, with the exceptions of the above examples (fan art and scholarships).

In the case of cancelation or redoing something from scratch, I retain the rights of repurposing, recycling and reselling the scrapped artwork.
9. Artist Disclaimer 2022
I am in my last semester of college (ends December 2022) and have a full-time job on that is laborious. Weekends are the only time I must dedicate to commissions AND college work at this time. Occasionally, a weekend will be taken off to relax.
At this time, the commission queue appears long and ominous. I am catching up on owed work – much of this list is from Patreon only commission opportunities, which allow Patrons to commission during closings. The list appears never ending at times. Regular commission openings are scheduled between currently queued work.
When you commission me, please keep these things in mind before agreeing to my TOS. I am only one person, and I have many other obligations in life than commissions.
I will try to update clients to the best of my ability on any delays. I may contact clients directly, or post an update on my social media, website, and Trello queue to reach a broader audience. You are always welcome to contact me with questions or concerns.
